The wedding photography contract is similar to other photography contract types, but with some specific considerations. If you need a generic photography contract, try using our photography contract template to get started. There's also a wedding planner template, which is specifically designed to include the elements of wedding planning. You can try combining these templates if your company provides both photography and planning services.

Wedding service providers are in a highly competitive business, and your wedding contract and other documentation, marketing materials, and interactions with your client need to be competitive as well. Look at other wedding contracts in your area and try to understand what your competitors are doing before going forward and designing your own wedding photography contract.

In a wedding photography contract, you need to determine what parts of the event you will be covering. The wedding is essentially a highly dense event with many different things going on and no time for a re-do. Weddings are also highly emotional events, and your clients, the bride and groom, may not be the most accessible people to work with during the marriage ceremony. That's why you'll want to have every detail smoothed out and well agreed at least several days before the wedding.

If you don't know who your clients are or how picky they might be, it's always best to include as much organization as possible in the wedding photography contract. Simplifying things by combining your services in two different package levels is always a good choice, but don't make things too simple. It’s easy to gloss over certain planning elements, only to realize after the wedding is over that there was a miscommunication or misunderstanding between yourself or your company and your clients.

Somewhere in the wedding photography contract, you'll want to have fully itemized lists of individual components. You’ll need to describe exactly how many minimum pictures that you will provide of the bride and groom, guests, table settings or even aerial shots from a drone. If you charge by the hour, you'll need to state precisely when you are expected to arrive and when you are expected to leave. Also, include what expenses should be required from the photography service provider.

If you provide physical materials such as photo prints, digital conversions, edited video, or other products, you'll need to list each item. You should also list the terms for delivery. Will you be sending things in the mail to your clients, or will you need to send them by courier or physically drop them off yourself? All of these terms and conditions need to be included in your photography contract.

Weddings are not 100% verified events. Sometimes weddings get canceled. That means that you need to have a cancellation clause in your wedding photography contract. Just in case the marriage gets canceled or postponed, you need to make sure that your company has some degree of compensation for all of the work and planning you have put into this project.

Depending on the area in which you are conducting photography, you may need to get licenses or permits ahead of time. You should have a clause for rescheduling or change of venue, just in case you need to get permits a second time. You may even want to list an alternate venue ahead of time, and charge your clients for the secondary licenses, in case it's not possible to get the permissions on short notice if that second option is selected.

A photography contract includes licensed works. Those licensed works are the digital photographs, which are technically the property of the person who takes the pictures. You should understand that it's not typical for photographers to sell those photographs technically. Licensing is a way to give the clients access to the data, the derivatives of the work, or printed works, without giving them the primary rights to the photography themselves.

In some cases, you can provide discounts on your photography services by including a “model release clause” in your photography contract. This empowers your company to use those photographs for promotional purposes, advertising, or any other use case for your firm. This is also known as a non-exclusivity clause. The client can then purchase exclusivity for an extra cost.

In our photography contract, we've included some protection causes for the photographer. These clauses include indemnification and other typical clauses for contracts. These contracts protect the photographer and the photography company from any perceived damages on the client’s side. In the photography contract, we also stipulate the potential dispute resolution terms, which are always fair to state in advance to protect against any potential disputes. By defining the dispute process, and specifying that disputes are first handled through arbitration, lawsuits often are protected from escalation and undue legal fees.

A photography contract is a binding legal contract, and as such, all of the terms and conditions are intended to be legally binding in court. Depending on your jurisdiction, you might have specific laws that apply to your photography contracts. You should customize your agreement to fit with the legal obligations of your city or state. For example, you might need specific licenses, certifications, or permits to conduct photography services. Especially if you operate a drone, you'll need to have proper licensing and authorization to be paid for those services commercially.

Now that you have a general idea of writing your photography contract, you can download our wedding photography contract template and get started. Wedding photography can be a lucrative and rewarding business. Just make sure that you take care of all the fine details, and you'll soon have plenty of happy customers.
